Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Façinations publication, gallery, and platform operated by Crosdale, Inc. ("Façinations," "we," "us"). By using the platform you agree to these Terms.

1. The Service

Façinations is (a) a monthly publication on Web3 art, provenance, and the new art finance, and (b) a curated marketplace and registry of original artwork operating on the FXNS contract. Galleries and artists publish inventory; collectors browse, request viewings, and complete acquisitions through the platform.

2. Eligibility

You must be at least 18 years old and able to enter into binding contracts. Gallery, artist, and collector memberships are subject to review and approval.

3. Acceptable use

You agree not to misrepresent works, infringe intellectual property, launder funds, or use the platform to facilitate any unlawful activity. We may suspend or terminate accounts for violations.

4. Payments and fees

Payments for artworks and subscriptions are processed by Braintree, a PayPal Service. Galleries pay a commission on completed sales (typically 10–15% of transaction value, set per relationship). All fees are stated in U.S. dollars unless otherwise specified. Taxes are the responsibility of the buyer and seller per applicable law.

5. Refunds and disputes

Refunds are governed by our Returns & Refunds policy. Disputes are first mediated by Façinations; unresolved disputes may be referred to binding arbitration.

6. Editorial content

Articles published in the Façinations magazine are the copyright of their respective authors and Crosdale, Inc. Subscribers may share articles for non-commercial purposes; redistribution at scale or for profit requires written permission.

7. Intellectual property — works

Galleries and artists retain all rights to their inventory and imagery. By publishing on the platform, contributors grant Façinations a limited license to display, market, and facilitate sale of the listed works.

8. Disclaimers

The platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or any particular outcome from listings, marketing, or on-chain mechanisms.

9. Limitation of liability

To the maximum extent permitted by law, Façinations' aggregate liability for any claim arising from the platform shall not exceed the fees paid to us by you in the twelve months preceding the claim.

10. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws principles.

11. Changes

We may update these Terms; material changes will be communicated by email or in-app notice at least 14 days before they take effect.
